The Terms govern the manner of use of our services and constitute the content of the contract for the use of the services of mobile application "Zašová - The Trinitarian Story" (hereinafter referred to as the "Application") between you and the operator of this service, which is the company Municipality of Zašová, with registered office at Zašová 36, 756 51, ID No. 00304476 (hereinafter referred to as the "Operator").
By accessing and using the services below, you agree to all of the Terms.
1. Privacy policy
1.1 The application needs to have access to the user's location for its operation and geolocation functions. However, the Operator does not upload or share any personal data from the Application, including data from location services, through the Application.
2. General provisions
2.1 Acceptance of the Terms and Conditions is established by launching the mobile application, which creates a contract for the use of the services between you (the User) and the Operator.
2.2 The Application is a mobile application for smartphones with Android (available at Google Play) and iOS (available at Appstore) operating systems, which guides the User to places of interest in the municipality of Zašová. It is a geolocation mobile game in which various tasks must be performed, which are communicated by a virtual guide during the game.
2.3 If you are under 15 years of age, you may only use our services with the consent of your parents or legal guardian, who agree to be bound by this Agreement.
2.4 The Operator is entitled to change the scope of the Application Services at any time without reason and without prior notice.
2,5 The basic scope of services is available to Users free of charge.

3. Service and their use, license
3.1 By entering into an agreement to use the Application Services, the Operator grants the User a limited, non-exclusive, non-transferable, fully revocable license to view and use the Services for your personal, non-commercial purposes in accordance with these Terms.
3.2 Operator may modify, suspend or discontinue any part of our Services at any time without limitation. The Operator may also restrict certain features offered through our Services without notice. Our Services include software that we may update on your device automatically when a new version is available. We are under no obligation to provide support for maintenance, software installation, etc. except as required by applicable law.
3.3 Making a copy of, copying, modifying, disposing of, assigning, transferring, selling or otherwise distributing the Services or other content of the Application in breach of these Terms is strictly prohibited without the prior written consent of the Operator. User may not copy, reverse engineer, translate, modify or create derivative works without the express written consent of Operator.
4. Liability for damages
4.1 Liability for damages shall be governed by generally applicable law and the provisions of these Terms and Conditions. The Operator shall not be liable for the availability and functionality of the services provided through the Application Service, in particular if caused by electronic communications service providers.
4.2 The Operator does not guarantee the availability, reliability, functionality, accuracy of the services and/or content and information that are listed and available through the Application Services.
4.3 The User bears all risks and the threat of possible damages related to or resulting from the use of the Application Services and the content available through our services.
4.4 In particular, the User is obliged to comply with all legal regulations and not to interfere with the rights and legitimate interests of third parties when performing tasks that are published on the Application Service.
4.5 The performance of tasks published on the Application Service is entirely voluntary and it is at the User's discretion whether or not he/she wishes to perform such tasks. The performance of such tasks may be dangerous and may take place in hard to reach places or potentially risky locations. The performance of topics and tasks may cause damage to the health and property of the user and/or third parties, and the user is always liable for such damage. Due to the fact that unforeseen risks may arise in the performance of tasks, the user must always make a proper assessment of whether objective and subjective conditions exist for the user to perform the task, including weather, physical fitness, terrain and experience in moving in the outdoor environment. The user always bears all risks associated with the performance of the tasks, the Operator shall not be liable for any damage to health and property arising from the use of our services.
4.6 The User shall be liable for any damages incurred by the Operator in connection with (a) the User's breach of any of the provisions of these Terms, (b) unauthorized use of the Services, or (c) violation of applicable law or other wrongful conduct.
5. Final Provisions
5.1 These Terms shall come into force and effect on 15 September 2023.
5.2 Any changes to the Terms shall be binding on the User upon launch of the Application.
